Purchase Terms and Conditions

1. General Provisions

These purchase and sale rules (hereinafter referred to as the “Rules”) establish the mutual rights, obligations, and responsibilities between a natural or legal person purchasing goods from the online store www.pudbuq.lt (hereinafter referred to as the “Buyer”) and Pudbuq, MB (hereinafter referred to as the “Seller”). By purchasing goods, the Buyer agrees to comply with these Rules.

2. Formation of the Purchase-Sale Agreement

2.1. The agreement between the Buyer and the Seller is deemed concluded from the moment the Buyer selects the goods to be purchased, forms a shopping cart, chooses the payment and delivery method, and clicks the “Buy” button. This agreement remains valid until the full performance of obligations by both parties under these Rules.

2.2. All purchase-sale agreements concluded between the Buyer and the Seller are registered and stored in the database of the online store www.pudbuq.lt.

2.3. The VAT invoice is sent electronically to the email address provided at the time of the agreement.

3. Buyer’s Rights

3.1. The Buyer has the right to purchase goods from the online store www.pudbuq.lt in accordance with these Rules and the applicable legal acts of the Republic of Lithuania.

3.2. The Buyer has the right to cancel the purchase-sale agreement concluded at the online store by notifying the Seller in writing within 14 days of the date of delivery of the goods. The Buyer may cancel the purchase-sale agreement only if the goods are of proper quality, have not been damaged, their appearance has not significantly changed, and they have not been used.

4. Buyer’s Obligations

4.1. The Buyer is obligated to pay the price of the goods and their delivery costs, as well as any other payments (if specified during the conclusion of the agreement) and to accept the ordered goods in accordance with these Rules.

4.2. If the information provided in the Buyer’s registration form changes, the Buyer must update it immediately.

4.3. By using the services of the online store www.pudbuq.lt, the Buyer undertakes to comply with these Rules and other terms set by the Seller and not to violate the applicable legal acts of the Republic of Lithuania.

5. Seller’s Rights

5.1. If the Buyer attempts to disrupt the operation or stable functioning of the online store or breaches their obligations, the Seller may, without prior notice, restrict or suspend the Buyer’s access to the online store and shall not be held liable for any losses incurred by the Buyer as a result.

5.2. In exceptional circumstances, the Seller may temporarily or permanently discontinue the operation of the online store www.pudbuq.lt without prior notice to the Buyer.

5.3. The Seller reserves the right to unilaterally amend these Rules. Amendments become effective from the moment of their publication and apply to all transactions concluded after their publication.

5.4. In the event of uncertainties regarding the information provided in the order, the Seller contacts the Buyer via the telephone number provided. The delivery period begins to count from the day of communication with the Buyer. The Seller reserves the right to cancel the Buyer’s order without prior notice if the Seller is unable to contact the Buyer within three (3) business days.

6. Seller’s Obligations

6.1. The Seller undertakes to provide conditions for the Buyer to properly use the services offered by the online store. The Seller does not guarantee that the online store will operate without interruptions or that data transmission will be error-free. The Seller is not liable for any losses incurred by the Buyer due to disruptions in the operation of the online store and/or data transmission errors.

6.2. The Seller undertakes to respect the Buyer’s privacy and protect their personal information provided in the online store www.pudbuq.lt. Such information may only be disclosed as required by the laws of the Republic of Lithuania. The Seller uses this information in accordance with the provisions of the "Personal Data Processing Rules."

6.3. In exceptional circumstances where the Seller is unable to deliver the ordered goods to the Buyer, the Seller undertakes to offer a substitute product. If the Buyer refuses the substitute product, the Seller agrees to refund the amount paid by the Buyer within 14 days. In such cases, the Seller is released from liability for failure to deliver the goods.

7. Delivery of Goods

7.1. By placing an order, the Buyer agrees that the order will be delivered via courier service. Delivery within Lithuania is free of charge, except for Neringa, where an additional fee applies. For deliveries to Neringa, please contact us via email at info@pudbuq.lt before placing an order.

7.2. Conditions for delivery to the Buyer:

7.2.1. Goods are delivered by the Seller or an authorized representative.

7.2.2. The Buyer undertakes to specify the exact delivery address and contact person.

7.2.3. For items weighing more than 31 kg, an additional lifting service is not provided. Goods are delivered to the entrance of the building.

7.3. The Seller delivers goods to the Buyer according to the delivery terms specified in the product descriptions. These terms are preliminary and do not apply if the required goods are not available in the Seller's warehouse. The Buyer acknowledges that, in exceptional cases, delivery may be delayed due to unforeseen circumstances beyond the Seller's control.

7.4. The Seller assumes no responsibility for delays in delivery if the goods are not delivered or are delivered late due to the Buyer's fault or circumstances attributable to the Buyer.

7.5. After concluding a purchase-sale agreement, the Buyer undertakes to check the email address provided in the order form until receiving a notification regarding the delivery of goods.

7.6. Upon delivery, the Buyer or their representative must inspect the condition of the package, the quantity, quality, and assortment of the goods, and sign the invoice, waybill, or other delivery-acceptance document in the presence of the courier. Once the Buyer signs such a document, the delivery is considered complete, and the goods are deemed to be in proper condition, without damages not attributable to manufacturing defects, and with no discrepancies in assembly. If the package is damaged (crumpled, wet, or otherwise externally damaged), or the goods are damaged or incomplete, the Buyer must note this on the invoice, waybill, or other delivery-acceptance document and, in the presence of the Seller or their representative, prepare a damage report. If the Buyer fails to perform these actions, the Seller is released from liability for damages not caused by manufacturing defects or discrepancies in assembly.

7.7. If discrepancies are identified, the Buyer or their representative must refuse to accept the shipment. In such cases, the Buyer and the courier prepare a damage report detailing the identified issues.

7.8. Delivery to the address specified by the Buyer is considered complete, regardless of whether the goods are received by the Buyer or another person at the specified address. If goods are not delivered on the scheduled delivery date, the Buyer must notify the Seller immediately, but no later than the following day. Otherwise, the Buyer forfeits the right to make claims against the Seller for non-delivery or delayed delivery.

7.9. If the ordered goods are not delivered within the specified delivery period and the Buyer has not been contacted by phone or email, the Buyer should contact the Seller via email at info@pudbuq.lt

7.10. The Buyer undertakes to personally accept the goods. If the Buyer cannot accept the goods, and they are delivered to the specified address based on the Buyer’s provided information, the Buyer has no right to make claims against the Seller for delivery to an incorrect recipient.

8. Return of Goods

8.1. Goods may be returned to the Seller without specifying a reason for the return. The Seller reserves the right to refuse returns for categories of goods listed in Clause 17 of the Retail Trade Rules, as well as for goods delivered based on a custom order.

8.2. Goods may be returned within 14 days from the date of receipt. If the return period ends on a non-business day, it is extended to the next business day.

8.3. To return goods, the Buyer must contact the Seller via email at skundai@pudbuq.lt, provide information about the goods to be returned, and attach proof of purchase.

8.4. The costs of returning goods are borne by the Buyer.

8.5. When returning goods, the Buyer must comply with the following conditions:

8.5.1. Returned goods must be in their original, intact packaging.

8.5.2. Goods must be undamaged and unused.

8.5.3. Goods must retain their original appearance (labels intact, protective films unremoved, etc.).

8.5.4. Returned goods must include all components as originally received by the Buyer.

8.6. Goods that are unsuitable due to form, size, color, model, or completeness (except as specified in the laws of the Republic of Lithuania) are accepted, replaced, or refunded within 14 days of return.

8.7. The Seller reserves the right to refuse returns if the Buyer fails to comply with the conditions set forth in this section.

8.8. In all cases, the Buyer must first contact the Seller via email at skundai@pudbuq.lt and proceed with the return only after receiving confirmation from the online store.

8.9. If incorrect goods are delivered, the Seller undertakes to accept them and replace them with the correct goods. If the correct goods are unavailable or the Buyer does not wish to receive them, the Seller will refund the amount paid by the Buyer within 14 days of returning the goods.

9. Liability

9.1. The Buyer is fully responsible for the accuracy of the data provided during the order process. If incorrect data is provided, the Seller is not liable for any consequences.

9.2. The Buyer is responsible for the consequences of sharing their data with third parties. If a person uses the Seller’s services by accessing the online store www.pudbuq.lt with the Buyer’s credentials, that person is deemed to be the Buyer.

9.3. The Seller is not liable for any losses incurred by the Buyer if the Buyer, despite having the opportunity, fails to familiarize themselves with these Rules or disregards the Seller’s recommendations and obligations.

9.4. The Buyer is responsible for all actions performed while using the online store www.pudbuq.lt.

9.5. The parties are liable for violations of the purchase-sale agreement concluded through the online store in accordance with the laws of the Republic of Lithuania.

9.6. If the Seller’s online store www.pudbuq.lt contains links to other companies, institutions, organizations, or individuals, the Seller is not responsible for the information provided or activities carried out by such entities. The Seller does not monitor, control, or represent such entities.

9.7. It is prohibited to use or distribute text or graphic information from the online store www.pudbuq.lt on other websites, media, or other platforms without the written consent of the online store www.pudbuq.lt.

9.8. The Seller is not responsible if the goods displayed on the online store www.pudbuq.lt differ in color, shape, or other parameters from the actual goods due to the technical characteristics of the Buyer’s equipment.

9.9. The Seller is not responsible if some goods in the online store www.pudbuq.lt are displayed as visualizations rather than actual photographs, which may result in differences in color, shape, size, or other parameters compared to the real goods.

9.10. The Seller is not liable for variations in the dimensions of upholstered furniture from those listed in the catalog. Such variations are normal and unavoidable due to the specifics of manufacturing technologies and material properties.

10. Quality Guarantee

10.1. A 24-month warranty is provided for the goods unless stated otherwise. The warranty period begins from the moment the Seller delivers the goods to the Buyer.

10.2. The warranty covers manufacturing defects and material deficiencies that affect the functionality or appearance of the furniture.

10.3. The warranty does not cover defects caused by natural wear and tear, improper use, accidental damage, or failure to adhere to the manufacturer’s care instructions.

10.4. The warranty does not apply in the following cases:

10.4.1. The Buyer or their authorized representatives violated the rules and instructions for transporting, storing, assembling, using, maintaining, or operating the goods.

10.4.2. Natural wear and tear of materials, such as upholstery.

10.4.3. Mechanical damage resulting from improper use of the furniture.

10.4.4. Furniture parts and materials that naturally wear out during use (e.g., textile, foam, springs, etc.).

10.5. The Buyer loses the right to the warranty if:

10.5.1. The furniture was transported, stored, or used in violation of the provided instructions.

10.5.2. Defects arose due to mechanical damage or natural wear and tear.

10.6. The warranty does not apply to discounted goods, naturally worn-out parts, or furniture fabric.

10.7. If defects occur during the warranty period, the Buyer must document the visible defects, provide a brief description, visual evidence, and a copy of the purchase-sale agreement. This information must be sent immediately to the Seller via email at skundai@pudbuq.lt

10.8. To resolve defects, the Buyer must deliver the goods or parts to the purchase location and provide the necessary purchase documents. The repaired goods or replacement parts must be collected by the Buyer from the purchase location.

10.9. The resolution of defects may take up to 60 business days.

11. Seller’s Marketing Practices

11.1. The Seller may, at its discretion, initiate various promotions on the online store www.pudbuq.lt

11.2. The Seller reserves the right to unilaterally amend or terminate promotions without prior notice. However, obligations arising during the purchase-sale process between the Seller and the Buyer remain valid even after the termination of the promotion.

12. Personal Data Processing

12.1. By clicking the “Buy” button, the Buyer confirms that they agree to provide their personal data to the Seller and consent to the processing of their personal data for the purposes of Buyer identification and contract conclusion and performance (online commerce).

12.2. By clicking the “Buy” button, the Buyer confirms that they and their representatives are aware of their right to refuse to provide their personal data but understand that personal data is necessary to identify the Buyer and/or their representatives for the purposes of contract conclusion and performance (online commerce). Without providing the data or consenting to its processing, the Buyer cannot conclude or execute the contract.

13. Communication

13.1. The Seller sends all notifications to the Buyer via the email address provided during the order process.

13.2. The Buyer sends all notifications and inquiries to the Seller via email at info@pudbuq.lt

14. Final Provisions

14.1. These Rules are drafted in accordance with the applicable laws of the Republic of Lithuania.

14.2. The relationships arising from these Rules are governed by the laws of the Republic of Lithuania.

14.3. All disputes arising from the implementation of these Rules shall be resolved through negotiation. If an agreement cannot be reached, disputes will be settled in accordance with the laws of the Republic of Lithuania.
